Abstract

This article examines the role of remote pre-trial protection of consumer rights within the human rights system. It argues that protecting consumer rights is not limited to resolving private legal disputes, but in certain cases is connected to the exercise of rights such as human dignity, equality, access to information, privacy, protection of personal data, judicial protection, and access to an effective legal remedy. At the same time, the article demonstrates that there is a sound scientific basis for equating any violation of consumer rights with a violation of human rights, and it identifies the boundaries connecting these two legal fields. It presents a comparative analysis of United Nations human rights instruments, international recommendations on online dispute resolution, the Constitution of the Republic of Uzbekistan, the Law “On the Protection of Consumer Rights,” and Presidential Resolution No. PP-296 of 6 October 2025, alongside the views of national and foreign legal scholars. The study puts forward proposals aimed at strengthening the legal guarantees of remote pre-trial protection, preserving the right to judicial appeal, reducing the adverse effects of digital inequality, safeguarding personal data, and ensuring the practical enforcement of the outcomes of electronic complaints.
